1. Quy định về đội mũ bảo hiểm cho người đi xe mô tô, xe gắn máy, xe đạp máy.

Theo khoản 2, điều 30; khoản 2, điều 31 Luật giao thông đường bộ và Điều 8 của Thông tư liên tịch số 06/2013/TTLT-BKHCN-BCT-BCA-BGTVT ngày 28/02/1013 của Bộ Khoa học và công nghệ - Bộ Công thương - Bộ Công an - Bộ Giao thông vận tải quy định người điều khiển, người ngồi trên các phương tiện xe mô tô, xe gắn máy, xe đạp máy khi tham gia giao thông phải đội mũ bảo hiểm “dành cho người đi mô tô, xe máy” có cài quai đúng quy cách.

1. Giải thích về “mũ bảo hiểm dành cho người đi mô tô, xe máy” và “cài quai đúng quy cách”.

* Theo khoản 2, điều 8 Thông tư liên tịch số 06 quy định “cài quai đúng quy cách” như sau:

Chỉ có mũ bảo hiểm đảm bảo chất lượng mới có tác dụng bảo vệ cho người đi xe máy khi chẳng may gặp tai nạn rủi ro.

Đội mũ bảo hiểm đúng cách: Mũ bảo hiểm khác với các loại mũ nên không phải muốn đội thế nào cũng được. - Mũ phải có cấu tạo đủ 03 bộ phận: vỏ mũ, đệm hấp thụ xung động bên trong vỏ mũ (đệm bảo vệ) và quai đeo.

- Được gắn dấu hợp quy CR (Đã được chứng nhận hợp quy)

- Trên mũ bảo hiểm có ghi nhãn hàng hoá theo quy định của pháp luật. Cụ thể: Nhãn mũ phải có đầy đủ các thông tin như: tên sản phẩm là “Mũ bảo hiểm cho người đi mô tô, xe máy”; tên và địa chỉ cơ sở sản xuất (hoặc tên và địa chỉ cơ sở nhập khẩu, xuất xứ - trong trường hợp là mũ nhập khẩu); cỡ mũ; tháng, năm sản xuất.

1. Quy định về xử phạt.

Căn cứ theo Nghị định 171/2013/NĐ-CP ngày 24/6/2019 của Chính phủ quy định xử phạt tiền từ 100.000 - 200.000 đồng đối với hành vi người điều khiển, người ngồi trên xe mô tô, xe gắn máy, xe đạp máy không đội mũ bảo hiểm “dành cho người đi mô tô, xe máy” hoặc đội “mũ bảo hiểm cho người đi mô tô, xe máy” mà không cài quai đúng quy cách.
